These terms govern your use of Silver Bow Technology Group's products, including Lineage CRM, Spam Hammer, and Drivetrain. This page includes our Terms of Service, Privacy Policy, and Acceptable Use Policy.
The master agreement between you and Silver Bow.
These Terms of Service (the "Terms") are a legal agreement between you and Silver Bow Technology Group, LLC ("Silver Bow," "we," "us," or "our"), the company behind Lineage CRM, Spam Hammer, and Drivetrain (each a "Service" and together the "Services").
By creating an account, clicking to accept, or using any of the Services, you agree to these Terms. If you are using the Services on behalf of an agency or other organization, you are agreeing on its behalf and represent that you have the authority to do so. In that case "you" refers to that organization.
If you do not agree to these Terms, do not use the Services.
You must provide accurate information when you register and keep it up to date. You are responsible for everything that happens under your account and for keeping your login credentials secure.
You must be at least 18 years old and able to form a binding contract to use the Services. The Services are intended for business use by licensed insurance professionals and the agencies that support them.
Notify us promptly at hello@silverbow.io if you believe your account has been accessed without authorization.
Some Services are offered on a paid subscription basis. Current pricing is shown at signup or on the applicable product page. Lineage CRM is billed as a monthly subscription; Spam Hammer is billed per phone number per month; usage-based charges (such as calling minutes or recordings) are billed as incurred.
Fees are billed in advance on a recurring basis and are non-refundable except where required by law. You authorize us and our payment processor to charge your payment method on each renewal until you cancel.
Charges may appear on your statement under the name "Silver Bow Technology Group" or a product name. We may change our fees on reasonable prior notice; changes take effect at your next billing cycle.
You can cancel at any time from your account settings or by contacting us. Cancellation stops future renewals; it does not retroactively refund the current term.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business purposes.
You agree not to: misuse the Services or interfere with their normal operation; attempt to gain unauthorized access to any system or data; copy, resell, or sublicense the Services without our permission; reverse engineer or attempt to extract source code except as permitted by law; or use the Services to violate any applicable law or the rights of others. Full details are in the Acceptable Use Policy below.
You retain ownership of the data you upload to the Services, including your leads, contacts, call records, and other content ("Customer Data"). You grant us the rights needed to host, process, and display Customer Data in order to provide the Services.
You are responsible for the accuracy and legality of your Customer Data and for having the necessary rights and consents to upload and use it, including any consent required to contact the individuals in your lead lists.
We handle personal information in Customer Data as described in the Privacy Policy below.
Spam Hammer monitors the reputation of phone numbers you register across major carriers and spam-labeling databases, and submits remediation requests when a number is flagged.
Spam Hammer helps improve and maintain the reputation of your numbers, but carrier and third-party labeling decisions are outside our control. We do not guarantee that any number will be cleared, remain unflagged, or achieve any particular answer or connection rate. Remediation timelines depend on the carriers and databases involved.
You are responsible for how you use your phone numbers and for conducting your calling in compliance with applicable law. Spam Hammer is a reputation-monitoring tool, not legal advice or a compliance service, and using it does not make your calling practices lawful on its own.
You must only register phone numbers that you own or are authorized to manage.
The Services integrate with third-party tools (for example, telephony providers, lead sources, calendar and email providers, and payment processors). Your use of those tools may be subject to their own terms, and we are not responsible for third-party services.
The Services, including all software, design, text, and trademarks (such as the Lineage CRM, Spam Hammer, Drivetrain, and Silver Bow names and logos), are owned by Silver Bow or our licensors and are protected by law. These Terms do not grant you any right to use our trademarks without our prior written permission.
If you send us feedback or suggestions, we may use them without obligation to you.
We work to keep the Services available and reliable, but we do not promise uninterrupted or error-free operation. We may modify, suspend, or discontinue features from time to time.
We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Services in a way that risks harm to us, other users, or third parties.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We do not warrant that the Services will meet your requirements, that results (including sales, contact rates, or spam-label outcomes) will be achieved, or that the Services will be secure or error-free.
To the fullest extent permitted by law, Silver Bow will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill.
Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the amount you paid us for the applicable Service in the twelve (12) months before the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Silver Bow from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your Customer Data, your use of the Services, your calling or messaging practices, or your breach of these Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration seated in Texas.
Nothing in these Terms prevents either party from seeking injunctive relief for the misuse of intellectual property or confidential information.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by email or an in-product notice. Your continued use of the Services after the changes take effect means you accept the updated Terms.
Questions about these Terms can be sent to Silver Bow Technology Group, LLC at hello@silverbow.io.
